Warning Letter Watch Terms of Service

Effective date: October 16, 2026

These Terms govern your use of warningletterwatch.com (the “Service”), operated by Visionary Alignment LLC, an Arizona limited liability company (“we,” “us”). By using the Service you agree to these Terms. If you do not agree, do not use it.

Informational data from public government records. Not legal, regulatory or compliance advice. Not affiliated with or endorsed by the FDA, USPTO, DOL or OSHA.

1. What the Service is

The Service provides data and alerts only: FDA warning letters, Form 483 observations and related enforcement records, drawn from openFDA (open.fda.gov, CC0 public domain) and FDA.gov. We do not provide legal, regulatory, compliance or other professional advice, and no professional relationship is created. Source: U.S. Food and Drug Administration (openFDA and FDA.gov). Use of this data does not imply FDA endorsement. No government agency sponsors, endorses or reviews the Service.

Nature of FDA records

FDA warning letters are informal and advisory. They are not final agency action and do not by themselves establish that a company broke the law. Form 483 observations are inspector observations, not final findings. Each record shows a status badge: Close-out issued or Unknown, with an “as of” date. We quote or closely paraphrase FDA’s own wording and do not add our own characterizations (for example, we do not label any company a “violator”). We do not display names of individuals; pages are about companies and facilities.

2. Data accuracy, completeness and lag

We mirror public government records, which can contain errors and change over time. FDA often publishes warning letters weeks or months after they are issued, and close-out letters may be posted later or not at all. We do not guarantee that any data or alert is complete, accurate, current or timely, or that an alert will be sent. Always check the official source before relying on any record. See our Corrections Policy.

3. No reliance for deadlines or decisions

Do not rely on the Service to meet any legal, regulatory or filing deadline, or as the sole basis for any business, legal, hiring, purchasing or investment decision. You are responsible for your own decisions and for verifying information with the official source or a qualified professional.

4. Accounts, free tier and Pro

You must be at least 18. You must give accurate information. The free tier is offered as-is and may be changed, limited or ended at any time. Paid (“Pro”) features are described on our Pro page at the time of purchase.

5. Founding-member subscriptions

6. Subscriptions after launch (auto-renewal)

These terms apply to every Pro subscription, including founding-member subscriptions under Section 5.

7. Acceptable use

You may not: (a) scrape, crawl or use automated means to copy the Service; (b) resell, sublicense, or bulk redistribute our data, pages or alerts, or build a competing database from them; (c) misrepresent our content or remove disclaimers or source attributions; (d) use the Service to harass anyone or for any unlawful purpose; (e) interfere with or overload the Service; or (f) share account access. Personal, internal business use and quoting small excerpts with attribution are fine. Underlying public-domain government records remain free for anyone to obtain from the agency; these limits apply to our compilation, software and presentation.

8. Intellectual property

The Service, its software, design, compilation, scoring and text we write are owned by Visionary Alignment LLC. Government records are public and not claimed by us. Trademarks of others belong to their owners.

9. Warranty disclaimer

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, MISSED DEADLINES, OR LOST RIGHTS, ARISING FROM THE SERVICE OR ANY DATA OR ALERT (OR ITS ABSENCE). OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THE 3 MONTHS BEFORE THE CLAIM AROSE (WHICH MAY BE $0 FOR FREE USERS). Some jurisdictions do not allow certain limits, so they may not apply to you.

11. Indemnity

You will defend and indemnify Visionary Alignment LLC against claims arising from your misuse of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service; if we discontinue a paid service, we will refund any prepaid, unused fees (including undelivered pre-orders). Sections 2–3 and 7–13 survive termination.

13. Changes

We may update these Terms. We will post the new version with a new effective date and, for material changes, notify account holders by email before they take effect. Continued use after that means you accept the changes.

14. Governing Law; Dispute Resolution; Arbitration

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules.

Informal resolution. Before filing a claim, you agree to submit the contact form and choose ‘Legal notice, cancellation or privacy request’, or write to Visionary Alignment LLC, P.O. Box 19241, Fountain Hills, AZ 85269, with a brief description of the dispute, and try in good faith to resolve it with us for 30 days.

Binding arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Maricopa County, Arizona (or by video/phone if the AAA rules allow). The award may be entered in any court with jurisdiction.

Class action waiver. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.

Small claims. Either party may bring an individual action in small claims court in Maricopa County, Arizona (or your county of residence if required by law) instead of arbitration, as long as the claim stays in small claims court.

IP / injunctive relief. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property or to stop scraping or misuse of the Service.
